Madras HC quashes patta issued in favor of Mayajal

CHENNAI: A division bench of Madras High Court on Thursday quashed a patta issued in favor of Mayajal Enterprises Private Limited in connection with two acres of land in Kaanathur Reddykuppam village on ECR, Chennai.

The bench comprising Justice T Raja and Justice K Kumaresh Babu passed the orders on disposing of an appeal by the Assistant Settlement Officer (North) Commissioner of Land Survey and Settlement, and Tahsildar, Chengalpattu Taluk (erstwhile).

The appellant officers sought direction to set aside the orders of Madras HC passed in 2015 and 2012 passed in favor of the company pertaining to the rights of the respondent.

The judges passed the order on the ground that the company which filed an application in 2003 seeking the land for lease had taken a different stand in 2011 claiming the rights of the land. The respondent filed another application before the revenue department seeking a patta for the land saying that they owned it for the past 12 years.

G Arun, Additional Advocate General, submitted that the respondent had suppressed the matter before the court and got an order in their favor. Concurring with the submissions of the AAG, the bench set aside the orders passed in 2015 and 2012.
