The Madurai Bench of the Madras High Court has told one Rajiv Gandhi that a petition against a Government official cannot be counted as a PIL.
Earlier, in order to question the merits of the Magistrate's decision to order a judicial custody to Jayaraj and Bennix without a trial, Rajiv Gandhi had moved the High Court.
Bench headed by Justice Sathyanarayanan and Justice Rajamanickam hearing the case examined the plea and concluded the plea's non-consideration as a PIL.
Rajiv Gandhi had said he first sent a missive to Madras High Court's Chief Justice AP Sahi and High Court Registrar, on not receiving proper communication he approached the Madurai Bench.
This stems from the case of infamous deaths of father-son merchants Jayaraj and Bennix in Sathankulam being arrested on June 19 who were ordered judicial custody without a proper trial. Complainant Rajiv Gandhi's claim is if there had been a proper trial the duo's lives would've been spared.
