The Madurai Bench of the Madras High Court on Wednesday sentenced six men in a murder case to life in prison after setting aside a lower court order of acquittal.
The petitioner claimed that his son Vallarasu, load man, was murdered by an armed gang of six at Yanaikkal Kalpalam in Madurai on August 27, 2010, owing to enmity.
Vilakkuthoon police had filed a case following the incident and arrested all those six men allegedly indulged in the crime. The case was tried in Madurai Sessions Court. During the trial, 23 witnesses were examined and marked 26 exhibits and 11 material objects on the side of prosecution after framing charges in the case. But without prosecuting the eyewitness, the trial court on September 6, 2010, had acquitted those six accused, identified as J Prabhu (27), G Suresh (27), B Veera alias Veeraselvam (27), G Pandi alias Chella Pandi (27), J Raja alias Pandiaraja (27) and G Pandi alias Periyapandi (29), who faced charges under Sections 148 and 302 read with 149 of the IPC.
The Vilakuthoon police failed to protect the witness and also failed to produce recovery witness cited as a witness in the chargesheet. There were many such lapses in the prosecution and hence the petitioner sought the bench to set aside the acquittal order by the Additional District and Sessions Judge and render justice. After hearing, the bench set aside the acquittal order and issued fresh order convicting those six men and sentenced them to life in prison.
